A Newport News man was sentenced to 95 years in prison on June 11, 2018, for making and possessing child pornography and for exposing himself to a 9-year-old child while making the pornographic videos.
Dustin Ele, 32, had pled guilty to 3 counts of possession of child pornography, first offense, and 97 counts of possession of child pornography second offense, on August 29, 2017. That same day Judge Timothy S. Fisher found him guilty of two counts of making child pornography, indecent liberties with a child under 13, and aggravated sexual battery of that same child.
The charges stem from a police raid conducted on April 1, 2016, after investigators in a task force Internet Crimes Against Children determined that an IP address linked to Ele’s home was downloading known child pornography. With a search warrant, Ele’s computers were seized and searched and thousands of images were located. The pornography mainly focused on girls ages 4 to 12.
Additionally, investigators found a number of photos of neighborhood children on Ele’s computer, some taken from his bathroom. They also found two sets of videos, made the summer of 2015, in Ele’s living room, of a girl sleeping over with a child then living in Ele’s home. In those two videos, which resulted in his manufacturing convictions, Ele masturbated to the girl’s presence, ejaculated into her hair and in one video he moved her clothes aside to photograph her genitals.
Ele admitted to downloading pornographic materials at the time of the raid and admitted to police that he liked child pornography because the children in the videos enjoyed it. He confessed to police that he took photos of the girl in his home while she was sleeping but contested at trial whether one video was pornographic since the girl was clothed, although he was not fully clothed. The defendant plans to appeal the manufacturing charges.
